1. Acceptance of Terms

By accessing or using the MmaGrove website (the "Site") and purchasing products, including but not limited to mice, keyboards, and controllers (collectively, "Products"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all terms, you must not use the Site or purchase any Products. These Terms apply to all visitors, users, and customers.

2. User Agreement & Conduct

You agree to use the Site solely for lawful purposes and in accordance with these Terms. You must not:

  • Use the Site in any way that violates applicable local, national, or international laws.
  • Attempt to interfere with the Site's security, functionality, or data integrity.
  • Submit false or misleading information, including during order placement.
  • Engage in any activity that disrupts the shopping experience of other users.

MmaGrove reserves the right to refuse service, cancel orders, or restrict access to the Site at its sole discretion, without prior notice, for any violation of these Terms.

3. Product Information & Pricing

We strive to ensure that all product descriptions, images, and pricing on the Site are accurate. However, errors may occur. MmaGrove reserves the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. In the event of a pricing error, we will notify you via email at [email protected] and offer the option to confirm the order at the corrected price or cancel it for a full refund.

4. Limitation of Liability

To the fullest extent permitted by applicable law, MmaGrove, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of Products, including but not limited to loss of profits, data, or business interruption. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount paid by you for the specific Product giving rise to the claim.

This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if MmaGrove has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

5. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, software, and design elements, is the property of MmaGrove or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, perform, or create derivative works from any content without prior written permission from MmaGrove. Unauthorized use of any intellectual property may result in legal action.

Any trademarks, service marks, or trade names displayed on the Site are the property of their respective owners. Your use of the Site does not grant you any license or right to use any intellectual property without explicit consent.

6. Refund Policy

MmaGrove offers a 30-day refund policy for all Products purchased directly from the Site, subject to the following conditions:

  • Eligibility: Products must be returned in their original condition, including all accessories, packaging, and documentation. Items showing signs of physical damage, misuse, or unauthorized modification will not be eligible for a refund.
  • Process: To initiate a refund, contact us at [email protected] within 30 days of delivery. You will receive a return authorization and shipping instructions. Return shipping costs are the responsibility of the customer unless the return is due to a defect or error on our part.
  • Refund Amount: Refunds will be issued to the original payment method within 5-10 business days after we receive and inspect the returned Product. The refund amount will be the purchase price of the Product, excluding original shipping charges. For defective or incorrect items, we will also refund return shipping costs.
  • Non-Refundable Items: Digital products, gift cards, and clearance items are non-refundable unless defective.

MmaGrove reserves the right to modify this refund policy at any time. Changes will be effective immediately upon posting on the Site.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the courts located in Delaware.
